OBSERVATIONS 25 DCMR CORRECTIVE ACTIONS
2. - Observed there was no certified food protection manager on duty at the time of inspection. (CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  203.1 Each person in charge shall be certified by a food protection manager certification program that is accredited by the Conference for Food Protection Standards for Accreditation of Food Protection Manager Certification Programs. Such certified food protection managers shall be deemed in compliance with Section 201.2(b). P  
10. - Observed the hand washing sinks have not been supplied with hand soap (automatic soap dispensers were not working).(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3001.1 Each handwashing sink or group of two (2) adjacent sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap. 10. - Observed there was no paper towels at the handwashing sink at the food prep area.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3002.1 Each handwashing sink or group of adjacent sinks shall be provided with: (a) Individual, disposable towels; Pf (b) A continuous towel system that supplies the user with a clean towel; Pf (c) A heated-air hand drying device that is provided in addition to other hand-drying devices at sinks used for food preparation or warewashing areas; Pf or (d) A hand drying device that employs an air-knife system that delivers high velocity, pressurized air at ambient temperatures. Pf  
29. - Observed establishment vacuum package food prior to obtaining variance approval from the DC health to do so. (CEASE AND DESIST- You are hereby ordered to Cease & Desist operation of vacuum packaging food EFFECTIVE IMMEDIATELY).  1010.1 A food establishment shall obtain a variance from the Department as specified in Sections 4102, 4103, and 4104 before: (a) Smoking food as a method of food preservation rather than as a method of flavor enhancement; Pf (b) Curing food; Pf (c) Using food additives or adding components such as vinegar as a method of food preservation rather than as a method of flavor enhancement or to render a food so that it is not potentially hazardous (time/temperature control for safety food); Pf (d) Packaging food using a reduced oxygen method except where the growth of and toxin formation by Clostridium botulinum and the growth of Listeria monocytogenes are controlled as specified in Section 1011; Pf (e) Operating a molluscan shellfish life-support system display tank used to store or display shellfish that are offered for human consumption; Pf (f) Custom processing animals that are for personal use as food and not for sale or service in a food establishment; (g) Preparing food by another method that the Department determines requires a variance; Pf or (h) Sprouting seeds or beans. Pf  
29. - Observed unpasteurized juice packaged on the premises has not been properly labeled; lacks the warning verbiage: "Warning: This product has not been pasteurized and, therefore, may contain harmful bacteria that can cause serious illness in children, the elderly, and persons with weakened immune systems."  907.1(b) Juice packaged in a food establishment shall be: Labeled, if not treated to yield a five (5)-log reduction of the most resistant microorganism of public health significance: Pf (1) As specified in Section 1102; Pf and (2) As specified in 21 C.F.R. Section 101.17(g) Food Labeling, Warning, Notice, and Safe Handling Statements, juices that have not been specifically processed to prevent, reduce, or eliminate the presence of pathogens with the following, "Warning: This product has not been pasteurized and, therefore, may contain harmful bacteria that can cause serious illness in children, the elderly, and persons with weakened immune systems." Pf  
32. - The establishment has not applied to the DC Health to obtain variance approval for vacuum packaging (reduced oxygen packaging). (CEASE AND DESIST- You are hereby ordered to Cease & Desist operation of vacuum packaging food EFFECTIVE IMMEDIATELY).  4103.1 A variance shall be requested in writing and be accompanied by the appropriate fee.  
37. - Observed unqualified health claims on labels put on packaged juice products made on the premises. (CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  1100.1 Packaged food shall comply with standard of identity requirements in 21 C.F.R. Sections 131 through 169 and 9 C.F.R. Section 319 - Definitions and Standards of Identity or Composition, and the general requirements in 21 C.F.R. Section 130 - Food Standards: General.
