OBSERVATIONS 25 DCMR CORRECTIVE ACTIONS
2. - There is no one on duty that has a District-issued Certified Food Protection Manager certificate.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  203.1 Each person in charge shall be certified by a food protection manager certification program that is accredited by the Conference for Food Protection Standards for Accreditation of Food Protection Manager Certification Programs. Such certified food protection managers shall be deemed in compliance with Section 201.2(b). P  
3. - The establishment did not provide proof of an employee health policy for the prevention of foodborne illness.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  300.1 The licensee shall require food employees and conditional employees to report to the person in charge, in accordance with this Section, information about their health and activities as they relate to diseases that are transmissible through food.  
5. - The establishment does not have approved procedures for responding to a contamination event due to vomiting or diarrhea.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  504.1 A licensee shall ensure that its food establishment shall have procedures for employees to follow when responding to vomiting or diarrheal events that involve the discharge of vomitus or fecal matter onto surfaces in the food establishment. The procedures shall address the specific actions employees must take to minimize the spread of contamination and the exposure of employees, consumers, food, and surfaces to vomitus or fecal matter. 10. - There is no handwashing signage at the handwashing sink in the kitchen and at the bar handwashing sink.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  3004.1 A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees and shall be clearly visibly to food employees.  
10. - There is no soap at the bar handwashing sink.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3001.1 Each handwashing sink or group of two (2) adjacent sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap. Pf  
10. - There are no paper towels at the bar handwashing sink.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3002.1 Each handwashing sink or group of adjacent sinks shall be provided with: (a) Individual, disposable towels; Pf (b) A continuous towel system that supplies the user with a clean towel; Pf (c) A heated-air hand drying device that is provided in addition to other hand-drying devices at sinks used for food preparation or warewashing areas; Pf or (d) A hand drying device that employs an air-knife system that delivers high velocity, pressurized air at ambient temperatures. Pf  
10. - Hookah equipment observed occupying the basin of the kitchen handwashing sink.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  2414.2 A handwashing sink shall not be used for purposes other than handwashing. Pf  
38. - Live cat observed roaming throughout the establishment.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3214.1 Except as otherwise permitted in Sections 3214.2 and 3214.3, live animals shall not be allowed on the premises of a food establishment. Pf  
38. - Neither the name of the establishment's licensed Pesticide Operator/contractor nor its pest extermination services contract are available.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3210.2 The licensee shall maintain a copy of the establishment's professional service contract and service schedule, and the following documents shall be available for inspection: Pf (a) Name and address of its District-licensed Pesticide Operator/contractor; (b) Frequency of pest extermination services provided under the contract; and (c) Date pest extermination services were last provided to the establishment.  
38. - Fly activity observed at the bar. Also, mouse droppings observed on the floor at the corner of the bar next to the beer keg refrigerator.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3210.1 The premises shall be maintained free of insects, rodents, and other pests. The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by: Pf (a) Routinely inspecting incoming shipments of food and supplies; Pf (b) Routinely inspecting the premises for evidence of pests; Pf (c) Using methods, if pests are found, such as trapping devices or other means of pest control as specified in Sections 3402, 3410 and 3411; Pf and (d) Eliminating harborage conditions. Pf  
47. - The cutting board on the prep table next to the walk-in refrigerator observed with visible wear.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  1801.1 Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized, or discarded if they are not capable of being resurfaced.  
47. - Plastic wrap from the manufacturer observed lining the exterior surfaces of the ventilation hood and the 3-compartment bar sink. Also, foil observed lining surfaces in the kitchen. Additionally, bare wood observed inside the walk-in refrigerator.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  1408.1 Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that require frequent cleaning shall be constructed of a corrosion resistant, nonabsorbent, and smooth material.  
48. - There are no chlorine test strips available to measure the concentration of the sanitizing solution.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  1608.1 A test kit or other device that accurately measures the concentration in micrograms per liter (mg/L) of sanitizing solutions shall be provided. Pf  
52. - A condensate line observed draining to a basin of the 3-compartment sink. Also, condensate from the walk-in refrigerator compressor observed draining to a container.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  2608.1 Condensate drainage and other nonsewage liquids and rainwater shall be drained from point of discharge to disposal according to applicable D.C. laws and regulations.  
53. - There is no toilet tissue provided for the toilet room.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  3007.1 A supply of toilet tissue shall be available at each toilet. Pf  
54. - The establishment could not provide a contract with a District-licensed trash or solid waste contractor.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  2717.2 The licensee shall maintain a copy of the establishment's professional service contract and the following documents shall be available for inspection: Pf (a) Name and address of its D.C. licensed trash or solid waste contractor; (b) Duration of the contract; and (c) Frequency of trash or solid waste collection services provided under the contract.  
55. - Unnecessary equipment (deep fryer, steam table, and other kitchen equipment) observed throughout the kitchen. Also, filled trash bags and unneeded equipment observed at the outside rear of the establishment.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  3213.1 The premises shall be free of: (a) Items that are unnecessary to the operation or maintenance of the establishment such as equipment that is nonfunctional or no longer used; and (b) Litter.  
55. - Ceiling tiles surrounding the ventilation hood observed missing. Also, holes observed on the walls inside the toilet room. Additionally, floor tiles observed missing near the entrance to the kitchen and baseboard observed missing near the door to the toilet room. Also, plastic paneling observed loosely attached to the wall above the 3-compartment sink.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  3200.1 The physical facilities shall be maintained in good repair.  
55. - Electrical wires observed exposed at the HVAC unit in the closet.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  2901.1 Utility service lines and pipes shall not be unnecessarily exposed.  
55. - Empty bottles and trash observed throughout the bar. Also, both the floor and shelves at the bar observed unclean.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  3201.1 The physical facilities shall be cleaned as often as necessary to keep them clean.  
56. - According to a DC Fire-EMS inspector that was on-site during the inspection, the fire suppression system supplied to the ventilation hood above the stove observed inoperable. As a result, a condemnation order, along with a "Do Not Use" sign, was posted at stove.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  1509.2 Commercial cooking systems shall be operated and maintained in good repair according to the D.C. Fire Code (2008) incorporating the International Fire Code (2006) or most recent edition as amended by the D.C. Fire Code Supplement, as amended (subtitle H of 12 DCMR). P  
56. - Grease accumulation observed on the ventilation hood.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  1509.4 Hoods, grease-removal devices, fans, ducts and other appurtenances shall be cleaned at intervals necessary to prevent the accumulation of grease.  
56. - The establishment does not have a contract with a District-licensed ventilation hood system cleaning contractor.(CORRECT VIOLATION WITHIN 5 CALENDAR DAYS)  1509.5 The licensee shall maintain on the premises a copy of the establishment's professional service contract and service schedule, which documents the following information: P (a) Name and address of its District-licensed ventilation hood system cleaning contractor; P (b) Frequency and extent of ventilation hood system cleaning services provided under the contract; P and (c) Date and time of ventilation hood system cleaning services were last provided to the establishment. P  
62. - Current health inspection reports are not posted in a conspicuous location.(CORRECT VIOLATION WITHIN 14 CALENDAR DAYS)  4306.3 All licenses, Certificate of Occupancy, and current inspection reports shall be conspicuously posted within the food establishment.  
66. - A condemnation order was placed on the stove, due to an inoperable fire suppression system supplied to the ventilation hood above said stove.  4709.1 The Department may condemn and cause to be removed any equipment, utensils or linens found in a food establishment, the use of which does not comply with this Code, or that is being used in violation of this Code, or that because of dirt, filth, extraneous matter, insects, corrosion, open seams, or chipped or cracked surfaces is unfit for use.

CEASE AND DESIST- You are hereby ordered to Cease and Desist operation of smoking tobacco products, including hookah, inside the establishment EFFECTIVE IMMEDIATELY. Please contact the area supervisor at (202)535-2180 or email food.safety@dc.gov for further direction.

NOTE: Establishment was not in operation during the investigation. Since the establishment was not in operation, the person-in-charge decided to voluntarily close establishment operations until all observations noted by DC Fire-EMS, DCRA, and DC Health have been corrected and approved by the respective Departments.
